The ruling on one who has intercourse with his wife during the day in Ramadan

Machine translationRead the Arabic original
His Eminence the Shaykh: A man had intercourse with his wife during the day in Ramadan without ejaculation?
If a man has intercourse with his wife during the day in Ramadan, and he is one upon whom fasting is obligatory,For five things follow from his intercourse: First: sin.

Second: the fast for that day is invalid.

Third: It is obligatory for him to abstain from food and drink.

Fourth: It is obligatory for him to make up the fast.

Fifth: He owes an expiation, and she: which is freeing a slave; if he does not find one, then fasting two consecutive months; if he is unable to do so, then feeding sixty poor people, even if he did not ejaculate; because intercourse necessitates the full ritual bath even without ejaculation, and it invalidates the fast even without ejaculation, and it invalidates Hajj even without ejaculation if it occurs before the first exit from the state of consecration.
As for the person who has intercourse with his wife during the day in Ramadan but fasting is not obligatory upon him, such as if he and his wife are traveling, and during the day he had intercourse with her while they were fasting, then there is no sin upon these two; rather, they break their fast for that day and eat and drink, and they make up that day later; because the traveler is not required to fast.

The questioner: He believed that the expiation is contingent upon ejaculation,Meaning: He knows that intercourse with ejaculation entails an expiation, but he does not know that intercourse without ejaculation is forbidden? The Shaykh: If this is his belief, then he owes nothing;because of His saying, the Exalted:
Our Lord, do not impose blame upon us if we have forgotten or erred.رَبَّنَا لا تُؤَاخِذْنَا إِنْ نَسِينَا أَوْ أَخْطَأْنَا
[Surat al-Baqarah: 286] .

The questioner: And he does not make up that day?The Shaykh: And he does not make up that day.
