Q1: I got married when I was very young and uneducated, and my husband would have intercourse with me during the day in Ramadan, and I was willing, but I did not know the punishment
He was also [in this state], and he has passed away, and I do not know the number of days, so what is obligatory upon me?

A1: It is obligatory for you to pay an expiation for every day on which intercourse occurred during Ramadan. The expiation is: freeing a slave if you are able, and if you are not able to free a slave, then you fast two consecutive months (sixty days). If you are not able to fast, then you feed sixty poor people, for every day on which intercourse occurred. If you do not know the number of days on which intercourse occurred, then you estimate them based on what is most likely in your opinion. Likewise, regarding your deceased husband, if he left an estate, then the expiation is paid out of his estate, as detailed in what we have mentioned. If one of his relatives or any Muslim wishes to fast on his behalf, that is good; due to the saying of the Prophet (peace and blessings be upon him):
'A'isha (Allah be pleased with her) reported Allah's Messenger (ﷺ) as saying: If anyone dies in a state (that he had to complete) some fasts, his heir must fast on his behalf.من مات وعليه صيام صام عنه وليه

It is agreed upon that it is authentic. If no one is available to fast on his behalf, and freeing a slave is not feasible, then he feeds on his behalf from his estate, for every day on which intercourse occurred, sixty poor people, with each poor person receiving half a sa' (a dry measure of about 3 kg) of the local staple food, such as rice or other. If he did not leave an estate and one of his relatives or one of the charitable people volunteers to feed on his behalf, that is good. It is obligatory for you to make up the days on which intercourse occurred, and to feed a poor person for each day for the delay in making them up, in the amount of half a sa' (a dry measure of about 3 kg) for each day, which is approximately one and a half kilograms of food. The deceased is made up for, and fed for the delay.
