Question: A person entrusted me with performing the obligatory Hajj on his behalf after his death. It is known that the deceased held beliefs regarding the awliya (close friends of Allah) and the dead, other than Allah, considering that they would be an intermediary for him with Allah. Is it obligatory for me to perform the obligatory Hajj on his behalf after his death, or not? And what is the evidence for this?

Answer: If a person entrusts you with performing the obligatory Hajj on his behalf, and he is known for major shirk (associating partners with Allah), such as calling upon the dead, seeking aid from them, making vows to them, slaughtering animals for them, and the like, then this entrustment is not valid, and the Hajj performed on his behalf is invalid. This is because no forgiveness is sought for the mushrik (one who associates partners with Allah), nor is Hajj performed on his behalf, and no deed benefits him, whether from himself or from another. This is based on the saying of Allah the Exalted:
Indeed, Allah does not forgive association with Himإِنَّ اللَّهَ لاَ يَغْفِرُ أَن يُشْرَكَ بِهِ
[Surah al-Nisa: 48], and His saying:
It is not for the Prophet and those who have believed to ask forgiveness for the polytheists, even if they were relatives, after it has become clear to them that they are companions of Hellfire.مَا كَانَ لِلنَّبِيِّ وَالَّذِينَ آمَنُواْ أَن يَسْتَغْفِرُواْ لِلْمُشْرِكِينَ وَلَوْ كَانُواْ أُوْلِي قُرْبَى مِن بَعْدِ مَا تَبَيَّنَ لَهُمْ أَنَّهُمْ أَصْحَابُ الْجَحِيمِ
[Surah al-Tawbah: 113]. If seeking forgiveness for them is forbidden, then performing Hajj on their behalf is the same or even more so.
