Question: I have a brother who passed away, and he owed the expiation for accidental killing, which is fasting two consecutive months. Is it permissible to fast these two months on his behalf? And is it permissible to divide them among my living brothers consecutively so that we may clear the debt of our deceased brother?

Answer: In the name of Allah, and praise is to Allah... It is prescribed for one of you to fast two consecutive months on his behalf, based on the saying of the Prophet (peace and blessings be upon him):
'A'isha (Allah be pleased with her) reported Allah's Messenger (ﷺ) as saying: If anyone dies in a state (that he had to complete) some fasts, his heir must fast on his behalf.من مات وعليه صيام صام عنه وليه

It is agreed upon that it is authentic.
The wali (guardian) is the close relative, and it is not permissible to divide the two months among a group of people. Rather, one person must fast them consecutively, as Allah has prescribed, based on His saying regarding the killer:
then [instead], a fast for two months consecutivelyفَمَن لَّمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ
[Al-Nisa: 92].
As for the one who is able to free a slave, it is obligatory for him to do so, and fasting does not suffice for him. May Allah guide them all.
