Question: What is the ruling of Allah and His Messenger regarding a group who observe the Day of 'Arafah a day after the Muslims observe it, and who believe that if any one of them performs Hajj without being accompanied by one of the Mulkarim, his Hajj is invalid?
Answer: No Muslim has the right to deviate from the community of Muslims, neither in Hajj nor in anything else; for Allah the Exalted said: : [Al-Imran: 103], and He said: [An-Nisa: 115], and the Prophet (peace and blessings be upon him) said: Sunan Abi Dawud 4607Sahih (Al-Albani), and he (peace and blessings be upon him) said in his Friday sermon: Sahih Muslim 867a, and he (peace and blessings be upon him) said: Jami` at-Tirmidhi 697Hasan (Darussalam).
The Muslims who performed Hajj with the Prophet (peace and blessings be upon him) stood with him at 'Arafah on the ninth day, and no one stood before him or after him. He (peace and blessings be upon him) said: This indicates that it is obligatory for Muslims to perform Hajj as the Prophet (peace and blessings be upon him) performed it, in the standing at 'Arafah, the departure to Muzdalifah, and other matters. Then his Rightly Guided Caliphs (may Allah be pleased with them) , namely Abu Bakr, 'Umar, 'Uthman, and 'Ali, followed his noble methodology; they stood on the ninth day, and the Muslims stood with them in their pilgrimages, and they did not stand before the ninth day or after it.
It is not reported from the Prophet (peace and blessings be upon him) or from his Companions (may Allah be pleased with them) that the Hajj of any Muslim is not valid unless the condition is that he performs Hajj with so-and-so or so-and-so.
This group that stands in Hajj after the Muslims are innovators who contradict the Shari'ah of Allah and what the Prophet (peace and blessings be upon him), his noble Companions, and their followers in goodness established. They have no Hajj; for Hajj is 'Arafah, so whoever does not stand at 'Arafah on the ninth day or on the night of the sacrifice (which is the tenth night) has no Hajj.
And their statement that it is necessary for the pilgrim among them to be accompanied by one of the Mulkarim is a condition that has no basis in truth. Rather, it is an invalid condition that contradicts the pure Shari'ah. It must be rejected and not considered. However, every Muslim must understand his religion and know its rulings in Hajj and other matters, so that he performs his worship, including Hajj and other acts, with knowledge. This is based on the saying of the Prophet (peace and blessings be upon him):Sahih Muslim 1037a, which is agreed upon as authentic.
Answer: No Muslim has the right to deviate from the community of Muslims, neither in Hajj nor in anything else; for Allah the Exalted said: :
And hold firmly to the rope of Allah all together and do not become divided
And whoever opposes the Messenger after guidance has become clear to him and follows other than the way of the believers - We will give him what he has taken and drive him into Hell, and evil it is as a destination.
You must then follow my sunnah and that of the rightly-guided caliphs. Hold to it and stick fast to it. Avoid novelties, for every novelty is an innovation, and every innovation is an error.
The best of the speech is embodied in the Book of Allah, and the best of the guidance is the guidance given by Muhammad. And the most evil affairs are their innovations; and every innovation is error.
The fast is the day the people fast, the breaking of the fast is the day the people break their fast, and the sacrifice is the day the people sacrifice.
The Muslims who performed Hajj with the Prophet (peace and blessings be upon him) stood with him at 'Arafah on the ninth day, and no one stood before him or after him. He (peace and blessings be upon him) said:
Take your rituals from me
