Is it permissible for a son to use a car his father gave him as a gift, when the price of the car was from forbidden wealth?

Machine translationRead the Arabic original
The questioner: Peace be upon you.

The Shaykh: And upon you peace.

The questioner : How is our Shaykh Abu Abd al-Rahman?

The Shaykh : Praise be to Allah, I am well.

The questioner : May we ask a question?

The Shaykh : Yes, you may.

The questioner : A brother of ours, his father gave him a car.

The Shaykh : Yes.

The questioner : Its price was five thousand dinars.

The Shaykh : Yes.

The questioner : And the price of the car is, of course, derived from funds that are, so to speak, close to riba or close to being forbidden.

The Shaykh : No, do not say "close to."

The questioner : Yes, he works in a hotel.

The Shaykh : ... .

The questioner : ... .

The Shaykh : Yes.

The questioner : Yes, he works in a hotel, and the hotel has intoxicants and other things that you know about.

The Shaykh : And why did you say "close to"?

The questioner : It was a slip of the tongue.

The Shaykh : No, by Allah, may it be a slip of the tongue, if Allah wills.

The questioner : Ah, of course, a slip of the tongue.

The Shaykh : If Allah wills, if Allah wills.

The questioner : If Allah wills.

The Shaykh : Yes.

The questioner : Is it permissible for this brother, who is his son, to use this car?

The Shaykh : And why are you talking about the car? Where does this son live? Is it not from the forbidden wealth?

The questioner : Ah, he is with his father.

The Shaykh : So why did you not ask about his food and drink and clothing, and ask about the car because there are five thousand in the matter?

The questioner : No, because the matter is that he wants to... his father... his father, after the five thousand, because there is... the fact that he is working.

The Shaykh : Who is working?

The questioner : His son himself.

The Shaykh : What is he working in?

The questioner : In the pharmacy, so he can support himself.

The Shaykh : And is he working in the pharmacy now?

The questioner : Yes, he is currently in the pharmacy, working.

The Shaykh : How old is he?

The questioner : How old are you? Twenty-four years old.

The Shaykh : Yes, and he is living with his father.

The questioner : He is living in his father's house.

The Shaykh : Okay, you are saying that he wants to take the car.

The questioner: Yes.

The Shaykh : Be patient, may Allah guide you.

The questioner: Yes.

The Shaykh : Be patient.

The questioner : Please, our Shaykh.

The Shaykh : You spoke and it is my turn, yes.

The questioner : Please, our Shaykh.

The Shaykh : So you are saying he wants to buy the car from him.

The questioner: Yes.

The Shaykh : And he wants to pay the value later.

The questioner: Yes.

The Shaykh : Okay, and the food and drink that they are eating from the forbidden wealth, does he want to pay that back too?

The questioner : No, that is not it.

The Shaykh : Is it permissible?

The questioner : ...

The Shaykh : In my opinion, it is not permissible; it is clear from the title.

The questioner : So, regarding our brother, what should he do with the car?

The Shaykh : May Allah guide you, can you give it to him?

The questioner : Ah, yes.

The Shaykh : Yes, the best thing is that the matter be handled directly, without an intermediary, that would be better.

The questioner : The owner of the house knows what is in it.

The Shaykh : Well done, perfect.

The questioner : Brother Fuad, speak with him, please, our Shaykh.

The Shaykh: All right.

The questioner : Peace be upon you, and Allah’s mercy and blessings.

The Shaykh : And upon you be peace, peace and the mercy of Allah and His blessings and His forgiveness.

The questioner : May Allah reward you with good, my uncle.

The Shaykh : May Allah bless you, what are they calling you? Abu what?

The questioner : Yes?

The Shaykh : What are they calling you? Abu what?

The questioner : They call me Fuad.

The Shaykh : I did not ask you for your name.

The questioner : Yes, I mean your kunya.

The Shaykh : Or I am telling you, Abu what? Is it a name or a kunya?

The questioner : Abu Muhammad.

The Shaykh : You have wasted my time, Abu Muhammad.

The questioner: Yes.

The Shaykh : If you had answered me immediately, we would have moved on with the matter, Abu Muhammad.

The questioner: Go ahead.

The Shaykh : Are you married?

The questioner : No, by Allah.

The Shaykh : If Allah wills, you will get married soon.

The questioner : May Allah bless you.

The Shaykh : Do you know that the religion is sincere advice? If your father is working in the hotel and serving intoxicants and so on.

The questioner: Yes.

The Shaykh : This wealth is all forbidden, and the Messenger (peace and blessings be upon him) said:
Hell is more fitting for him whose flesh is nourished by what is unlawful. كلُّ جسدٍ نَبَتَ من السُّحت فالنار أولى به
Mishkat al-Masabih 2825Sahih (Al-Albani)
, so the Fire is more deserving of him; therefore, since you have reached the age of youth and you are earning your livelihood from the labor of your hand and the sweat of your brow, it is not permissible for you to rely on your father's earnings.

The questioner: Yes.

The Shaykh : And may Allah pardon what has passed, and you must repent to Allah and earn your food, drink, clothing, and everything from lawful wealth, I mean, not from the forbidden wealth, which is your father's earnings.

The questioner: Yes.

The Shaykh : And therefore, do not buy the car.

The questioner: Yes.

The Shaykh : This is if, as your questioner said, your father wants to sell it to you and then over the days you will pay him its value of five thousand.

The questioner: Yes.

The Shaykh : Since he bought it with forbidden wealth, do not help him. And if you have influence over your father and you are able to advise him in the way I am advising you, advise him to change his craft, his job, and his position, and to start a new life in lawful earnings; that is better for him and more lasting. And our Lord says:
And whoever fears Allah - He will make for him a way out (3) And will provide for him from where he does not expect. وَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مَخْرَجًا " وَيَرْزُقْهُ مِنْ حَيْثُ لَا يَحْتَسِبُ
[At-Talaq 65:2-3]
; so the summary of the answer is: do not buy your father's car, and do not continue to eat from him and drink from him; break away from this and earn your sustenance from the labor of your hand and the sweat of your brow. And peace be upon you.

The questioner : May Allah reward you.

The Shaykh : And may He reward you.

The questioner : May Allah reward you with good, may Allah bless you.
