Question: A woman asks and says: She had an excuse, meaning she was menstruating, and her family wanted to go for 'Umrah because no one would remain with her if she delayed behind them. She went with them for 'Umrah and completed all the conditions of 'Umrah, including tawaf and sa'y, as if she had no excuse, out of ignorance and out of shame that her guardian would know about it, especially since she was illiterate and did not know how to read or write. What is obligatory for her?

Answer: If she entered the state of ihram with them for 'Umrah, she must repeat the tawaf after performing ghusl and repeat the shortening of the hair from her head. As for sa'y, it suffices her according to the more correct of the two opinions of the scholars. However, if she repeats sa'y after tawaf, that is better and more cautious. She must also repent to Allah (Glorified and Exalted is He) for her tawaf and for praying the two rak'ahs of tawaf while she was menstruating.
If she has a husband, it is not permissible for him to have intercourse with her until she completes her 'Umrah. If he did have intercourse with her before she completed her 'Umrah, the 'Umrah is invalid, and she owes a sacrificial animal, which is a head of livestock: a one-year-old camel, a one-year-old sheep, or a two-year-old goat, to be slaughtered in Makkah for the poor. She must also complete her 'Umrah as we mentioned earlier, and she must perform another 'Umrah from the miqat from which she entered ihram for the first 'Umrah, in place of her invalid 'Umrah.
However, if she performed tawaf and sa'y with them out of politeness and modesty, but she did not enter the state of ihram for 'Umrah from the miqat, then she owes nothing except repentance to Allah (Glorified and Exalted is He); because 'Umrah and Hajj are not valid without ihram, and ihram is the intention of 'Umrah or Hajj, or the intention of both. We ask Allah for guidance and well-being for everyone, protection from the whispers of Satan.
