Q2: My wife has a question she wants answered, may Allah reward you with good: Before her marriage, she went with her maternal uncle, my father’s brother, to perform 'Umrah and visit al-Madinah al-Munawwarah to complete the 'Umrah. During the journey, while inside the house, her menstrual period started. It was the first time it had happened to her, and she was shy to tell her relatives and her uncle that
she was menstruating. She went with them to Makkah and al-Madinah , and she performed the 'Umrah, including the tawaf, sa'y, and prayer inside the house, while she was still menstruating . She also visited al-Madinah al-Munawwarah completely, and she was still menstruating, but she was too shy to tell her relatives and her uncle. Here is the question: Does she have a sin for that or not? And if she does have a sin, what is the expiation and what should she do? May Allah guide you to what He loves and is pleased with, and may Allah reward you with good.

A2: Your wife’s tawaf while she was menstruating is not valid, and she was still in the state of ihram for 'Umrah at the time of your marriage to her. Consequently, her 'Umrah became defective because you had intercourse with her while she was still in her ihram. It is obligatory for her to go to Makkah in the state of ihram and perform the 'Umrah, and this 'Umrah will be the defective one. Then, after she exits the state of ihram from this 'Umrah, she must go to the miqat from which she entered ihram for the first 'Umrah that became defective, and enter ihram from there for a second 'Umrah to make up for the first one. She must also slaughter a sheep in Makkah that is acceptable as an 'Id sacrifice and distribute it to the poor of Makkah , and this is because you had intercourse with her while she was in the state of ihram for 'Umrah. If your marriage contract with her was made while she was in the state of ihram, it is necessary to renew the contract after she has completed the acts of 'Umrah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
