The first question of Fatwa No. ( 2252 )
Q1: A woman entered the state of ihram for 'Umrah, then she menstruated, so she did not perform tawaf or sa'y, and she returned to her home and removed her state of ihram. Is there anything required of her? And if she had not removed her state of ihram, is there anything required of her?
A1: If a woman enters the state of ihram for 'Umrah and then menstruates, and she removes her state of ihram before performing tawaf and sa'y, then if she was ignorant of the ruling and her husband did not have intercourse with her, it is obligatory for her to complete her 'Umrah after her menstruation ends, then to perform ghusl from it, just as one performs ghusl from janabah. She then performs tawaf and sa'y and removes her state of ihram by shortening the hair of her head, and there is nothing required of her. However, if intercourse took place, her 'Umrah is invalid, and she must complete it by performing tawaf, sa'y, and shortening the hair. It is also obligatory for her to make up for it by performing a 'Umrah in its place from the miqat from which she entered ihram for the first one. She must also offer a sacrificial animal; either a sheep from the sheep breed that is six months old or older, or a goat from the goat breed that is one year old or older, to be slaughtered in Makkah and distributed to its poor. As for if she had not removed her state of ihram from her 'Umrah, she must complete her 'Umrah by performing tawaf and sa'y and removing her state of ihram from her 'Umrah by cutting some of the hair of her head. Her 'Umrah is not invalidated by menstruation in any case.
