Ruling on slaughtering the hady before the Day of Sacrifice
Machine translationRead the Arabic original
Question: We entered the state of ihram as a group performing tamattu', so we performed 'Umrah and exited the state of ihram. Some of us suggested slaughtering the hady and distributing it in Makkah, and indeed the slaughter was carried out in Makkah. Then we learned afterwards that the slaughter is not to be done except after stoning the Jamarat al-Aqabah. I knew this and advised them to postpone the slaughter to the Day of Sacrifice or after it, but they insisted on slaughtering one day after our arrival and the performance of 'Umrah. What is the ruling on this? And what is required of us in this situation?
Answer: Whoever slaughters the blood of tamattu' before the Day of Sacrifice, it does not suffice for him; because the Messenger of Allah (peace and blessings be upon him) and his Companions did not slaughter except on the Days of Sacrifice. They arrived while in the state of tamattu' on the fourth day of Dhu al-Hijjah, and the sheep and camels with them remained held back until the Day of Sacrifice came. If it had been permissible to slaughter them before that, the Prophet (peace and blessings be upon him) and his Companions would have hastened to do so during the four days they stayed before their departure to 'Arafah; because people needed meat at that time. So when the Prophet (peace and blessings be upon him) and his Companions did not slaughter until the Day of Sacrifice came, that indicates that it does not suffice, and that whoever slaughters before the Day of Sacrifice has contradicted the Sunnah and introduced a new legislation, so it does not suffice; just as one who prays or fasts before the time, so fasting in Ramadan before its time is not valid, nor is prayer before its time, and the like of that.
So the conclusion is that this is an act of worship performed before its time, so it does not suffice. He must repeat this slaughter if he is able, and if he is unable, he must fast three days during Hajj and seven days when he returns to his family, making ten days in place of the slaughter; due to the saying of Allah the Exalted: [Surat al-Baqarah: 196].

then whoever performs 'umrah [during the Hajj months] followed by Hajj [offers] what can be obtained with ease of sacrificial animals. And whoever cannot find [or afford such an animal] - then a fast of three days during Hajj and of seven when you have returned [home]. Those are ten complete [days]
