Peace be upon you, and the mercy of Allah and His blessings. After that:
Your letter, dated 27/4/1391 AH, has been received, may Allah guide you. The questions it contained were known, and here is their text and answer:
What is the ruling of the noble Shari'ah regarding a man who has resided in the Noble Mecca for years, and who performs Hajj with the people of Mecca, entering the state of ihram for Hajj from Mecca, while his family is in Hadramawt? Is his ruling that of the non-resident pilgrim regarding the sacrificial animal and fasting; because Allah says in His Noble Book:
This is for those whose family is not in the area of al-Masjid al-Haramذَلِكَ لِمَن لَّمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ
[Al-Baqarah 2:196]
Or is his ruling that of the people of Mecca in this regard?

Answer: If he is a resident of Mecca, his ruling is that of the people of Mecca; he owes no sacrificial animal and no fasting. However, if he only stayed for a need and his intention is to return to his homeland, then his ruling is that of the non-residents. If he performs 'Umrah from the area outside the sacred precinct after Ramadan and then performs Hajj in that year, he will be a pilgrim performing tamattu' from 'Umrah to Hajj, and he owes the sacrificial animal for tamattu'. If he does not find one, he must fast ten days: three during Hajj and seven after completing Hajj, or after returning to his family if he travels to them.
