This is a matter for consideration; because they are not settled residents; and because they are not visitors during the time of Hajj, so they are between these and those. When Allah, Glorified and Exalted is He, mentioned Tamattu' and the sacrificial animal in it, He said: [al-Baqarah:196]. For this reason, the scholars differed regarding such a case: is such a person considered among those present at al-Masjid al-Haram because he is a resident before the 'Umrah and before the Hajj, or is he considered a visitor because he is not a settled resident, but rather he resided for a need, and he will return to his country?
This is a place for consideration and possibility, and the most cautious opinion for me, and the closest opinion for me: is that such a person is not, in reality, among those present at al-Masjid al-Haram; because he only stayed for a temporary reason, and resided for a temporary reason, such as teaching, or seeking knowledge, or another job, and then he returns to his country. So the most cautious thing for him is the sacrificial animal, and that he treat himself as one of the visitors for Hajj. This is the most cautious.
And the opinion that he is among those present at al-Masjid al-Haram, and that he is included with them, is a strong opinion, one that cannot be refuted, a very strong opinion.
