The Ruling on a Wife Giving Her Gold to Her Husband

Question: If a man buys gold or silver for his wife, and he needs it, and his wife gives him what he bought for her, is he required to return to her what he took from her?

Answer: If she gave him her gold and jewelry as a gift out of her own generosity, then Allah, Mighty and Majestic, says:
But if they give up willingly to you anything of it, then take it in satisfaction and ease.فَإِنْ طِبْنَ لَكُمْ عَنْ شَيْءٍ مِنْهُ نَفْسًا فَكُلُوهُ هَنِيئًا مَرِيئًا
[Surat al-Nisa: 4]. If she is pleased with it, there is no blame on him. However, if she gave it to him as a loan to meet his need, with the intention that he would return it to her, then he must return it when he becomes wealthy. He must return what he took from her. If he returns it to her, even if she did not say so, out of his own good will, that is better because she was kind to him. She should be rewarded with good conduct, even if she gave it to him not as a loan, but as assistance. If he becomes wealthy and returns what he took to her, that is better and among the noble traits of character and good reward. But he is not obligated to return it if it was a gift from her out of her own good will; he is not obligated to return it.
As for if she was shy of him and feared his harm, such as that he would divorce her, and gave it to him for that reason, then it is better that he return it to her when he becomes wealthy, even if she did not say anything. He should return it to her, because she gave it to him out of fear of his treachery and harm, or out of fear that he would divorce her. This happens often with women. The husband should possess noble traits of character, and when he becomes wealthy, he should return to her what he took from her.
