Question: From 'Abd al-'Aziz ibn 'Abd Allah ibn Baz to the honorable brother, the esteemed President of the Bisha Court, may Allah grant him success in all good. Amen.
Peace be upon you, and Allah's mercy and blessings. After that:
O Beloved, your noble letter number (676), dated 3/4/1390 AH, has been received. May Allah guide you. I have reviewed the attached copy of the record, which contains your documentation of the nature of the divorce pronounced by the husband upon his wife. It states that he divorced her by saying: "Talaq, talaq, talaq, talaq," and that he did not divorce her before or after that, and that his wife corroborated this. She stated that she had three menstrual cycles after the aforementioned divorce. As for her guardian, who is her brother, he corroborated that he did not pronounce a divorce before or after that, and stated that he was not present at the divorce that took place, but his sister informed him of it, and it was as he mentioned. This is after you heard the statements of the divorcer, the divorced woman, and her guardian. And because the husband confessed to me that his wife grabbed him by his pocket and strangled him severely, demanding her divorce, so he pronounced the aforementioned divorce upon her with the intention of getting rid of her harm, because he was unable to repel her, and he repeated the divorce due to the intensity of his anger, but he did not intend the three divorces or anything else. And because two witnesses testified to you that they know nothing about the aforementioned husband except good, as is documented in the copy of the record mentioned above.

Answer: Based on all of the foregoing, I have issued a fatwa to the husband that one divorce has taken effect upon his wife with this divorce, and he may return to her with a new marriage contract, because she has exited the waiting period ('iddah). The words of divorce uttered after the first word are considered a confirmation for him, and nothing takes effect from them other than the aforementioned divorce, as the scholars have explicitly stated in such cases, and as is not hidden. I hope that you will inform everyone of the aforementioned fatwa.
