Prohibition does not lie with the husband, but with the pure Shari'ah

Machine translationRead the Arabic original
Question: The husband, K. A. D., came to me, accompanied by the wife's guardian, S. M. F. Also present were N. M. F., the sister of the aforementioned guardian on her mother's side, who is the ex-wife of the aforementioned husband K. A. D., and the mother of the aforementioned husband. The husband admitted that he had divorced his wife once about two years ago, then taken her back, and then divorced her with three divorces in a single phrase, saying, "You are forbidden to me and permissible to another," due to a dispute that occurred between them. As a result of this dispute, his aforementioned mother struck him, which angered him, and the aforementioned divorce was pronounced about eight days ago. When his mother and his ex-wife were asked, they both confirmed this. As for the wife's guardian, he stated that he was not present at the time and knows nothing about it except from the statements of the aforementioned individuals.

Answer: Based on this, I issued a ruling to the aforementioned individual that his last divorce resulted in a single divorce for his aforementioned wife, which is added to the previous divorce, and he may take her back as long as she is in the waiting period, because it is authentically reported from the Prophet (peace and blessings be upon him) what indicates this.
As for his statement, "You are forbidden to me and permissible to another," it is an interpretation of the aforementioned divorce that has no legal effect; because prohibition does not lie with him, but with the pure Shari'ah. He took her back in my presence, in the presence of her aforementioned sister, and a witness, and thereby she became under his protection. We informed him that pronouncing three divorces at once is not permissible, and that he must repent for that. We advised them all to fear Allah and to treat each other with kindness.
Said by the one who is poor in need of the forgiveness of his Lord, 'Abd al-'Aziz ibn 'Abd Allah ibn Baz, may Allah forgive him, and may Allah send prayers upon our Prophet Muhammad, his family, and his Companions.
