Prohibition of marrying off women without their consent

Machine translationRead the Arabic original
Question: My father forcibly contracted the marriage of my sixteen-year-old sister to a man she does not like, and she is trying to kill herself by every means, saying: "Death is more beloved to me than him."

Answer: A marriage like this is an abomination and is not permissible, nor is it valid according to the most correct opinion of the scholars; because the Prophet (peace and blessings be upon him) prohibited marrying off women without their consent, and he informed that the consent of an unmarried woman is her silence. When a slave girl informed him (peace and blessings be upon him) that her father had married her off while she was averse to it, the Prophet (peace and blessings be upon him) gave her the choice between staying with him or leaving.
And what some of the Bedouins and others have become accustomed to, of marrying off unmarried women without consulting them, is a bad and invalid custom, and coercion does not bring good, but rather it harms everyone.
And what I see is: that you should mediate through people of good to annul this marriage. If the mediation succeeds, that is what is required; otherwise, present the matter to the court, which, if Allah wills, will resolve the problem. May Allah guide them all.
