The deceased's wealth is the right of the heirs and is not to be spent on charitable projects

Machine translationRead the Arabic original
Question: From 'Abd al-'Aziz ibn 'Abd Allah ibn Baz / To the honorable brother / M. N. S. 'A., may Allah guide him to what pleases Him. Amen.
Peace be upon you, and Allah's mercy and blessings. After that:
Your question reached me through the newspaper (al-Jazirah), and its text is:
Your brother passed away and left amounts of money with some people. This money has been collected and is now with you. You wish to spend it on charitable projects, and you have performed Hajj on his behalf from your own money... and so on.

Answer: Your performance of Hajj on his behalf from your own money is sufficient, and it discharges the obligation that was upon him. May Allah reward you with good and multiply your reward.
As for the aforementioned money, it is obligatory to divide it among the heirs. If there is any difficulty regarding a bequest or anything else, refer to the court. What the court deems sufficient is sufficient, if Allah wills. May Allah guide everyone to what pleases Him.
And peace be upon you, and Allah’s mercy and blessings.
