We are returning to Your Excellency the complete documents related to the inquiry of the aforementioned: M. B. N., which came to us from Your Excellency under number: 212, on 14/2/1417 AH, regarding breastfeeding.
Accordingly, we inform you: that we sent the complete documents to the Honorable Judge of the Qouz Court by our letter number: 305/1, on 20/2/1417 AH, requesting the completion of what was included in your aforementioned explanation. His Honor returned them to us under number: 365, on 24/2/1417 AH, containing the completion of what was referred to, and he attached for us a copy of the attached record, which documents what was carried out.
I hope you will review the documents and the attached copy of the record, and take whatever action you deem necessary regarding the fatwa for the aforementioned, may Allah reward you. And peace be upon you and the mercy of Allah and His blessings.
Answer: And upon you be peace and the mercy of Allah and His blessings, as for what follows:
Based on what the Honorable Shaykh / Judge of the Qouz Court recorded, regarding the nature of the breastfeeding issued by the grandmother of the wife of: M. B. N., and her admission before him that she does not remember the number of feedings, I issued a fatwa to him that his marriage is valid and his wife remains in his protection, and that the aforementioned breastfeeding is not relied upon, and the rulings of breastfeeding are not established by it; because one of the conditions of breastfeeding that results in prohibition is that it be five known feedings or more, provided that the child is within the first two years.
So I hope you will notify everyone of the aforementioned fatwa. May Allah reward your efforts, and multiply the reward for us and for the Shaykh. And peace be upon you and the mercy of Allah and His blessings.
