Is the one who returns the greeting with "hala" or "marhaban" a sinner?

Answer:
He has deviated from the Sunnah. It is obligatory for him to return the greeting with "and upon you be peace"; for Allah said:
And when you are greeted with a greeting, greet [in return] with one better than it or [at least] return itوَإِذَا حُيِّيتُمْ بِتَحِيَّةٍ فَحَيُّوا بِأَحْسَنَ مِنْهَا أَوْ رُدُّوهَا
[Surat al-Nisa: 86]. However, he should be taught and directed toward what is good.
