Explanation of the author's statement: "…If two people dispute it, the one superior in it is preferred, then the one superior in religion and intellect…"

Machine translationRead the Arabic original
The Shaykh : "They disputed it" means they competed for it. It means each of them wants to be the mu'adhdhin (the one who calls to prayer). For example, two men come to this mosque, each wanting to be the mu'adhdhin. It is known that this applies to a mosque that does not have a designated mu'adhdhin. If a mu'adhdhin has been designated for it, the matter remains as it was, based on the saying of the Prophet (peace and blessings be upon him)
No man must lead another in prayer where (the latter) has authority لا يؤمن الرجل الرجل في سلطانه
Sahih Muslim 673a
. Similarly, a man does not call to prayer in the presence of another mu'adhdhin. So if a mu'adhdhin has been appointed for the mosque, it is not permissible for anyone to compete with him, because he is a person of status and has occupied a position prescribed by the Shari'ah, so it is not permissible to encroach upon him. But if the mosque is currently seeking a mu'adhdhin and two mu'adhdhins come forward, each saying "I am the one," the author says "the one superior in it is preferred". Superior in it means superior in the adhan (call to prayer), meaning in what relates to the adhan, he is the one preferred. For example, does the voice fall under this? The one with the better voice and performance, and the stronger one, is preferred. Trustworthiness also falls under this. Knowledge of the time also falls under this. So they look at the one superior in the adhan. Why? Because they competed for a job, so the one most upright in performing it is preferred. And Allah the Exalted said
Indeed, the best of those you hire is the strong and trustworthy one إن خير من استأجرت القوي الأمين
. Then, after that, the one superior in religion and intellect. Superior in religion is clear; it means if we find that one of them is more devoted to Allah (Mighty and Majestic) than the other, we prefer him. Then, in intellect. What is intellect? It means having the intellect to organize oneself and to get along with people. Because some people do not have a broad mind and cannot bear even the slightest thing from people. So if this man is intelligent and we know that he will be patient with the harm of people, because no matter who a person is, there will inevitably be objection and harm from people, and if the person is intelligent, he becomes more tolerant. The author did not mention the one superior in knowledge, and this is a matter that is necessary. So we prefer the one with more knowledge, because the one who is not knowledgeable may be ignorant of some matters. He may be ignorant of some matters. So if someone says, perhaps that is taken from his statement "the one superior in it", such that the one with more knowledge of the rulings of the adhan is included in his statement. What? "The one superior in it." If this word encompasses the one with more knowledge, then that is what is required. And if it does not encompass it, then it is obligatory for us to look at his knowledge. Because, for example, if a mu'adhdhin comes late, he is asked: does he call to prayer, or does he limit himself to the adhan of the other mosques? If he has knowledge, yes, he knows how to handle the situation. And likewise, if he has intellect, he knows how to handle the situation. If he is more intelligent, he says, "By Allah, half an hour has passed now. If I call to prayer now, I will cause confusion for the people, and the obligatory prayer has already been established by the adhan of those around me. So I will not call to prayer, because this is intellect." And for this reason, he said "then the one superior in religion and intellect"
