If a woman entered the state of ihram for 'Umrah and started menstruating before the tawaf, and she did not inform her family, so she performed the tawaf and sa'y and returned to her country, and a marriage contract was concluded for her, what is the ruling?

Machine translationRead the Arabic original
The Shaykh : Now, if a woman entered the state of ihram for 'Umrah and started menstruating before the tawaf, and she was too shy to tell her family that she was menstruating, and she performed the tawaf and sa'y and returned to her family, and a marriage contract was concluded for her, what do you say?

The questioner : ... .

The Shaykh : My brothers, glory be to Allah, a woman performing 'Umrah had her menstruation come before the tawaf, and she was too shy to inform her family, so she performed the tawaf while menstruating, and performed the sa'y, and shortened her hair, and returned to her country, and then a marriage contract was concluded for her. What is the ruling on the contract?

The questioner : It is not valid.

The Shaykh : Why? Because she did not remove her state of ihram, so her tawaf is not valid and her sa'y is not valid, and shortening the hair is an easy matter. In any case, this woman must go and complete her 'Umrah, and then the contract must be concluded anew. Look, these matters are serious. This is why, when she was shy about the truth, she was punished with this punishment
But Allah is not shy of the truth والله لا يستحيي من الحق
[Al-Ahzab 33:53]
. It is obligatory that neither a man nor a woman be shy about the truth. When a man asked the Messenger (peace and blessings be upon him), he said, "O Messenger of Allah, I have intercourse with my wife but do not ejaculate; is the ghusl obligatory for me?" He said,
I do it, and this one إني أفعله أنا وهذه
pointing to 'A'ishah,
and I perform the ghusl وأغتسل
"What is this that one is shy about?" But why did he not feel shy? Because it is the truth. And when 'Umar ibn Abi al-Salamah asked him about the kiss of the fasting person, and Umm Salamah, the mother of the child, was with him, he said,
Ask this سل هذه
meaning his mother. The Messenger (peace and blessings be upon him) used to kiss her while fasting. He said, "O Messenger of Allah, you are not like us. May Allah forgive you for your past sins." He said,
I hope I am the most God-fearirg of you, and possess the best knowledge among you of those (things) against which I should guard إني لأرجو أن أكون أخشاكم لله وأتقاكم له
Sahih Muslim 1110
or something like that. In any case, it is not permissible for a person to be shy about the truth that is obligatory upon him. And praise be to Allah, this is something people share. When some people laughed at a fart, do you know what a fart is? It is the gas that makes a sound. The Prophet (peace and blessings be upon him) said,
Why should anybody laugh at what he himself does? علام يضحك أحدكم مما يفعل
Sahih al-Bukhari 4942
"Do you not do it yourself? Do you laugh when you do it alone in your own mind?"

The questioner : No.

The Shaykh : We have never heard of anyone who farted while alone and laughed, ever. So why do you laugh at others? But in any case, people laugh because it is, meaning, bad manners for a person to show the sound of a fart among people. And praise be to Allah, this is good etiquette. We say, do not show it and do not laugh. And Allah knows best. Yes?
