The ruling on the claim that zakah is not paid except to the Prophet (peace and blessings be upon him)
Machine translationRead the Arabic original
If one of those who withhold zakah says that zakah is not paid except to the Messenger (peace and blessings be upon him), is he considered one who interprets the text?
He is to be taught. If he persists, he is to be fought. If Allah guides him, the zakah is taken from him by force, and he is punished with a discretionary financial penalty, as in the hadith of Bahz ibn Hakim:Sunan Abi Dawud 1575Hasan (Al-Albani). However, if he fights, he is to be fought, just as the people of apostasy were fought when they fought; al-Siddiq fought them. But if he does not fight and is within reach, he is compelled to pay.
He is to be taught. If he persists, he is to be fought. If Allah guides him, the zakah is taken from him by force, and he is punished with a discretionary financial penalty, as in the hadith of Bahz ibn Hakim:
we shall take half the property from him as a due from the dues of our Lord, the Exalted
وإنَّا آخذوها وشَطرَ مالِه عَزَمةً من عزَماتِ ربِّنا
