Question: My mother was afflicted with a memory loss disease, and we treated her but did not achieve a result. Four years passed with her in this condition, and she did not fast days of Ramadan; sometimes she would eat during the fast due to forgetfulness, despite her good health. Then she passed away as a result of an accident: she went out of the house without our permission, got lost, and after searching for her, we found that a young car driver had hit her, fled, and left her, and she died.
What should I do about the days she left and did not fast? And should we waive her blood money from the one responsible—despite him being wealthy—or should I take the blood money and give it in charity to those who are entitled to it?

Answer: If her mind had changed and her memory had changed so that she could not keep track of anything, then her mind was disordered, and nothing is required of her if her mind was disordered and she no longer kept track of matters. So nothing is required of her, and you do not have to fast on her behalf. As for the blood money, you should take the blood money, and it is lawful for you and an inheritance for you; so you take the blood money and dispose of it like your other wealth: you eat from it, or give it in charity, or do other things with it that Allah has made permissible.
