The ruling on one whose shoes were stolen and he took a replacement for them

Machine translationRead the Arabic original
Question:
Shoes are often stolen, so I find them or something similar to them. Is it permissible for me to take them? Please advise us, may Allah reward you.

Answer:
The safest course is to leave that alone; because the person who took your shoes may not be the owner of the shoes that are present. The same applies to sandals.
As for when they are similar—similar sandals—and you took your sandals, and something similar to them remained, then the opinion that taking them is permissible is a close one; because similarity is the operative cause. But if they are not similar, then it is not permissible to take them; because the person who took them may not be their owner. So the solution: leaving them is the safest course.
