The Reciter: In the name of Allah, the Most Merciful, the Most Compassionate.
Praise be to Allah, Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, and upon his family and all his Companions.
He said, may Allah have mercy on him, "Chapter on the Emphasis of the Prohibition of the Orphan's Wealth
Allah the Exalted said:[An-Nisa 4:10]
And He said:[Al-An'am 6:152]
And He said, the Exalted:[Al-Baqarah 2:220]
From Abu Hurayrah (may Allah be pleased with him), from the Prophet (peace and blessings be upon him), who said:Sahih al-Bukhari 2766 Agreed upon by al-Bukhari and Muslim "
The Shaykh : In the name of Allah, the Most Gracious, the Most Merciful.
The author said, may Allah have mercy on him, in his book *Riyad al-Saliheen* "Chapter on the Prohibition of the Orphans' Wealth"
Orphans are those whose fathers died before they reached puberty, whether they are male or female. These, I mean the orphans, are a place for gentleness, care, mercy, and compassion, because the death of their fathers has broken their hearts, and they have no provider except Allah (Mighty and Majestic). Thus, they are a place for gentleness and care. For this reason, Allah recommended them in His Book and urged mercy toward them in many verses. It is not permissible for a person to consume the wealth of orphans unjustly, due to the saying of Allah the Exalted:[An-Nisa 4:10] There are some people, and may Allah protect us from that, whose brother dies and leaves young children, so he takes charge of their wealth and trades with it for himself, and may Allah protect us from that, and disposes of it without right and without benefit for the orphans. These people deserve this warning that they consume fire into their bellies. We ask Allah for safety.
And He said, the Exalted:[Al-An'am 6:152] meaning, do not deal with the wealth of orphans except in the way that is best. So if you have two projects and you want to invest the orphan's wealth in one of them, look at which is closer to benefit, profit, and safety, and do that. It is not permissible for you to do what is worse for your own benefit or for the benefit of a relative or the like. Rather, look at what is best. If it is unclear to you whether there is benefit for the orphan or not, do not dispose of it; do not dispose of it; hold onto the money. Because Allah said: [Al-An'am 6:152] So if it is unclear to you, do not do it. It is not permissible for you to lend anyone from the orphan's wealth. That is, a person comes and says, "Lend me, for example, ten thousand riyals, a hundred thousand," and you have the orphan's wealth. It is not permissible for you to lend to him, because he may be unable to repay, and there is no benefit for the orphan in lending to him. And if it is not valid to lend to someone else, it is even more so that you should not borrow it yourself. And some guardians of orphans, and may Allah protect us from that, dare to borrow the orphan's wealth for themselves and dispose of it for themselves, and the profit is for them and the gain is for them, and the orphan's wealth is not to be borrowed. And Allah says: [Al-An'am 6:152] So if you see that this project is better and you participate in it, and Allah decrees that this project loses, then nothing is upon you, because you are a mujtahid (one who exercises independent legal reasoning), and the mujtahid, if he is correct, has two rewards, and if he errs, he has one reward. But if you intentionally leave what is better for what is below it, this is forbidden upon you.
And Allah (Blessed and Exalted is He) said:[Al-Baqarah 2:220] And this verse was revealed in response to a question the Companions posed to the Prophet (peace and blessings be upon him): They said: O Messenger of Allah, we have the wealth of orphans, and the house is one and the food is one. How do we act? If we put the food of these orphans in a separate vessel, we would be troubled, and it might spoil for them. What do we do? So Allah the Exalted said: "Reform for them is best. And if you mix with them, they are your brothers." Meaning, do what is best and mix with them; make the pot one and the vessel one. And since you intend reform, Allah knows the corrupter from the reformer. And if Allah had willed, He would have made it difficult for you and burdened you, but He (Glorified and Exalted is He) is Merciful to the believers.
Praise be to Allah, Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, and upon his family and all his Companions.
