Question:
This questioner says: When the guardian of the orphans' property is a man who works in their interests and helps the workers in the farm and cares for this farm, and then he takes from the fruit of this farm; knowing that he does not take a wage for his help in this farm, and the fruit is very abundant, making these orphans independent of what the guardian took, is that permissible?

Answer:
Allah (Exalted and Majestic is He) said regarding orphans:
And whoever, [when acting as guardian], is self-sufficient should refrain [from taking a fee]; and whoever is poor - let him take according to what is acceptable.وَمَنْ كَانَ غَنِيًّا فَلْيَسْتَعْفِفْ وَمَنْ كَانَ فَقِيرًا فَلْيَأْكُلْ بِالْمَعْرُوفِ
[Surat al-Nisa: 6] If he is wealthy, it is obligatory for him to refrain, and if he is in hardship, he should ask the one in authority, the judge, to determine a known wage for him.
As for if he is poor; then he eats in a customary manner, he eats with the orphans in a customary manner, according to need, and there is no blame on him from the orphans' property, he eats from it, drinks, and clothes himself according to need without extravagance. As for the one whom Allah has made wealthy; then he should refrain, and not eat anything. If he wants a wage for his work; then that is through the judge, through the court. Yes.
