Chapter on the Prohibition of Intercession in Fixed Punishments: Allah the Exalted said
Machine translationRead the Arabic original
The Shaykh : As for the second chapter: “it is the prohibition of intercession in the hadd”, meaning: in the punishment prescribed by the Shari'ah.
Know that the punishments for sins are divided into two categories:
Otherworldly punishments: these are in the hands of Allah, and Allah the Exalted said:[An-Nisa 4:48], so every sin other than shirk (associating partners with Allah) is capable of being forgiven by Allah (Mighty and Majestic) by His grace and mercy.
As for the worldly punishment: it has many categories, some of which are specific and defined in the Shari'ah: these must not be exceeded. For example, the thief’s hand is cut off, and it is not permissible to cut off his leg along with his hand, nor to gouge out his eye, nor to maim his ear; it is not permissible to exceed what Allah and His Messenger have defined, which is? What is it?
The student: Cutting off the hand.
The Shaykh : Cutting off the hand.
Likewise, zina (unlawful sexual intercourse): if the fornicator has not married before, his hadd is a hundred lashes and exile for one year. Exile for one year means: driving him out of the town to another town for a period of one year. This also must not be increased or decreased, because it is one of the hudud (fixed punishments).
And like those who wage war against Allah and His Messenger, and who spread corruption in the land: their punishment is that they be killed, or crucified, or their hands and feet be cut off from opposite sides, or they be exiled from the land.
There are other punishments that are not fixed; these are referred to the opinion of the ruler, meaning the Shari'ah judge or the one who organizes and codifies punishments. This matter is broad; sometimes the punishment is with money.
