The Book of Marriage.

Machine translationRead the Arabic original
The Shaykh : Then the author (may Allah have mercy on him) said: "The Book of Marriage"
He said: "The Book," and that is because it contains many chapters. We have mentioned previously that scholars classify their works into books, chapters, and sections. A book is a genus that encompasses many species, such as the Book of Purity, which includes water, vessels, cleaning oneself after relieving oneself, the ablution for prayer, the full ritual bath, dry ablution with clean earth, removing ritual impurity, and menstruation.
A chapter contains a type of knowledge, a species of a genus. For example, the chapter on water is a species with respect to what? To purity. The ablution for prayer is a species with respect to purity, and so on.
A section is a collection of issues of one type. Authors turn to sections either because the chapter is long or because the issues are important, as detailing the matter—section by section, section by section—prevents boredom and tedium.
The Book of Marriage is mentioned because it is a genus that encompasses many things, as will come if Allah wills.
First: We will speak about the ruling on the marriage contract, and this will come in the hadith of Ibn Mas'ud. But what is the definition of the marriage contract? The word "nikah" is originally derived from gathering together. It is said, "The people intermarried," meaning they gathered together among themselves. As for its meaning in the Shari'ah, it is a gathering between a man and a woman in a specific manner. A gathering between a male and a female in a specific manner. This manner is what the Shari'ah indicates regarding the marriage contract with its known conditions.
