Question:
I have heard you say more than once that the one who intentionally delays the Fajr prayer becomes a disbeliever. So, based on this, if he contracts a marriage while not praying Fajr, is it valid?

Answer:
This is a matter of scholarly disagreement. The majority hold that if he does not deny its obligation, he does not become a disbeliever, but rather commits minor shirk (associating partners with Allah). The correct view is that it is major shirk (associating partners with Allah) if he intentionally leaves the prayer until its time has passed, deliberately and without any excuse. A disbeliever does not contract a marriage for a Muslim woman. If her guardian does not pray, another guardian should be sought. The one who does not pray does not act as her guardian. If her father does not pray, her brother, son, or uncle should contract the marriage for her; the closest relative takes precedence.
