Q: I am married to a woman and I have four children from her. She is currently pregnant with the fifth, but she has not prayed since I married her until now. So what do you advise me to do, O honorable Shaykh?
A: This is a great evil; because prayer is the pillar of Islam, and it is the greatest and most important of the obligatory acts after the two testimonies, as Allah the Exalted said: [Surat al-Nur:56] And He the Exalted said: [Surat al-Baqarah:43] And He the Exalted said: [Surat al-Baqarah:238] And He the Exalted said: [Surat al-Tawbah:5] And He the Exalted said: [Surat al-Tawbah:11].
And the Prophet (peace and blessings be upon him) said:Sunan Ibn Majah 1079Sahih (Darussalam) It was narrated by Imam Ahmad and the people of the Sunan with a sound chain, and he (peace and blessings be upon him) said: Sahih Muslim 82b It was narrated by Muslim in his Sahih.
The woman is like the man in this matter, so that indicates that one who does not pray is not left alone, but is killed, and that he is not a brother in religion.
So it is obligatory to call her to repentance and to discipline her until she prays, and whoever repents, Allah accepts his repentance. If she refuses, it is obligatory to refer her case to the court so that they call her to repentance. If she repents, otherwise she is killed as an apostate from Islam, even if she acknowledges its obligation, according to the most correct of the scholars' opinions, due to the previous verses and the two previous hadiths. And it is obligatory for her husband to separate from her until she repents, and to renew the marriage contract after repentance. As for the questioner's children from her, they are legitimate for you because of the doubt regarding the marriage contract. And success is from Allah.

وَأَقِيمُوا الصَّلاةَ وَآتُوا الزَّكَاةَ وَارْكَعُوا مَعَ الرَّاكِعِينَMaintain with care the [obligatory] prayers and [in particular] the middle prayer and stand before Allah, devoutly obedient.
حَافِظُوا عَلَى الصَّلَوَاتِ وَالصَّلاةِ الْوُسْطَى وَقُومُوا لِلَّهِ قَانِتِينَBut if they should repent, establish prayer, and give zakah, let them [go] on their way
فَإِنْ تَابُوا وَأَقَامُوا الصَّلاةَ وَآتَوُا الزَّكَاةَ فَخَلُّوا سَبِيلَهُمْBut if they repent, establish prayer, and give zakah, then they are your brothers in religion
