Q: A. S. M. from the Sultanate of Oman says in his question: What is the ruling on the imam remaining silent after he recites al-Fatihah so that the ma’mum can recite al-Fatihah? And if he does not remain silent, when does the ma’mum recite al-Fatihah?

A: There is no explicit, authentic evidence indicating the prescription of the imam remaining silent until the ma’mum recites al-Fatihah in the loud prayers.
As for the ma’mum, it is prescribed for him to recite it during the pauses of his imam if he pauses. If that is not feasible, the ma’mum recites it quietly, even if his imam is reciting, and then he listens to his imam afterward, due to the generality of the statement of the Prophet (peace and blessings be upon him):

The imam was made to be followed, so do not differ with him. When he says takbir, you say takbir, and when he recites, you listen.إنما جعل الإمام ليؤتم به فلا تختلفوا عليه، فإذا كبر فكبروا، وإذا قرأ فأنصتوا

This hadith was narrated by Muslim in his Sahih. If the ma’mum forgets to recite al-Fatihah or is ignorant of its obligation, it is dropped from him, just as one who arrives while the imam is bowing; he bows with the imam, and that rak’ah suffices for him according to the most correct of the two opinions of the scholars, which is the opinion of the majority of the people of knowledge, due to the hadith of Abu Bakrah al-Thaqafi (may Allah be pleased with him) that he came to the mosque while the Prophet (peace and blessings be upon him) was bowing, so he bowed before the row and then entered the row. The Prophet (peace and blessings be upon him) said to him after he had completed the prayer:
May Allah increase your eagerness! But do not do it again.زادك الله حرصًا ولا تعد
Sunan Abi Dawud 683Sahih (Al-Albani)
. And he did not order him to make up the rak’ah. Narrated by al-Bukhari in his Sahih.
As for the imam and the one praying alone, reciting al-Fatihah is a pillar of the prayer for them according to the majority of the people of knowledge, and it is not dropped from them in any way as long as they are able to perform it.
