The Shaykh : A man had a slave woman, and his friend came and sold her to another man. The buyer had intercourse with her, and the owner of the slave woman, when his friend informed him that he had sold her, said, "May Allah reward you with good. I am confirming the sale, and I have no objection." The school of thought among us is the Hanbali school, and the well-known position among them is that the sale is not valid. Why? Because the seller is neither the owner of the slave woman nor her agent, so he has no right to dispose of her. The second opinion is that if he approves it, the sale becomes valid. Based on this, this case falls under property in which there is a dispute. This is what the scholars call the action of a *fadhuli* (an unauthorized person), meaning a disposition that is suspended pending approval; it is considered an unauthorized action.
