Issue: If one swears an oath and doubts whether he said “if Allah wills.”

Machine translationRead the Arabic original
The Shaykh : All right, if he doubts whether he said “if Allah wills” or not? A man swears an oath and comes to ask us, saying, “By Allah, I do not know whether I said ‘if Allah wills’ or not.” We say that the original state is the absence of that, meaning the absence of saying “if Allah wills”; that is the default. However, Shaykh al-Islam says that if it is his habit to make an exception and say “if Allah wills,” it is to be judged according to his habit. If he says, “By Allah, I do not know if I said ‘if Allah wills’ this time or not, but I know from myself that every time I swore an oath, I said ‘if Allah wills,’” we tell him to revert to his habit, because the apparent evidence here is stronger than the default. Shaykh al-Islam cited as evidence for this issue that the Prophet (peace and blessings be upon him) referred the woman with irregular bleeding to her habit. So this is proof that habit has an effect, knowing that the woman with irregular bleeding may have her menstrual period shift its place due to the irregular bleeding, or it may not shift, and yet the Prophet (peace and blessings be upon him) referred her to her habit. Yes...?
