The Shaykh : And if he is knowledgeable and strong, that is because of the evidence of his open sinfulness. The evidence is the saying of Allah the Exalted:
O you who have believed, if there comes to you a disobedient one with information, investigate يا أيها الذين آمنوا إن جاءكم فاسق بنبأ فتبينوا
[Al-Hujurat 49:6]
So Allah Mighty and Majestic commanded us to verify the report of the open sinner. This indicates that his report is not accepted absolutely; that is, it is not accepted on the basis of absolute acceptance, but rather it must be verified. It is well known that judgment includes the report, because the judge says to the plaintiff and the defendant, "This is the ruling of Allah." Therefore, his ruling includes the report, so it is not accepted. As for the reasoning, it is because the open sinner is not trusted not to deviate due to his open sinfulness, and the effects of sins on the heart, direction, and behavior are very apparent. Therefore, it is not valid for him to be a judge. However, we must know that this condition is applied or implemented according to what is possible. If we do not find anyone but a sinful judge, then we appoint him, but we choose the one who is lightest in sin, based on the saying of Allah the Exalted:
So fear Allah as much as you are able فاتقوا الله ما استطعتم
[At-Taghabun 64:16]
Otherwise, if we look at our society today, we will not find anyone who is free from a trait that makes them an open sinner, except for whom Allah wills. Backbiting is open sinfulness, and it exists in abundance; it exists in abundance. Absenteeism from work and persisting in it, and the fact that he does not arrive until an hour after the start of work and leaves an hour before the end of work, for example, persisting in this is open sinfulness because it is contrary to trustworthiness; it is betrayal and consuming wealth unjustly, because any salary you receive for work not done is from consuming wealth unjustly. If we also look at our society, we will find many people who are negligent about letting their garment hang below the ankles; they are negligent about letting their garment hang below the ankles and do not care if they let it hang. We also find many people who are negligent about their beard, either by shaving it or shortening it. If we do not find among people someone who possesses the attribute of justice, then we appoint the one who is lightest in sin. Good.
