The questioner : A man built a mosque and left a bequest that when he dies, he should be buried in the rear of the mosque on the inside. The man has died and was buried in the place he bequeathed to be buried. After a period of time, some people removed the grave markers and left its surface level with the floor of the mosque. Now, there are people praying on the surface of the grave without knowing it is there. What is the ruling on their prayer, and what must we do with this mosque or the grave?

The Shaykh : This bequest is invalid because mosques are not graveyards, and burial in a mosque is not permissible. Carrying out this bequest is forbidden. It is obligatory to dig up this grave and remove it to the Muslim cemetery. Therefore, what is obligatory for them is to dig up his bones and then bury them in a grave in the cemetery.
