The Ruling on Zakah on Fruits

Machine translationRead the Arabic original
Question:
The first message in this episode is from the Egyptian Republic, North Sinai Governorate, from the listener 'Abir 'Abd al-Khalig. Sister 'Abir has a message that includes more than one issue. In the first issue she asks about, she says: Is zakah obligatory on apricots? We hear many opinions on this topic; some people say it is obligatory, and some say it is not. Please guide us regarding this fruit and similar fruits. May Allah reward you with good.

Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance. As for what follows:
This fruit, apricots, and its like do not have zakah. Zakah is only in what is stored, such as grapes and dates. As for apricots, pomegranates, and the like, there is no zakah in them because they are eaten at their season, and they are not from what is stored or measured.
The point is that there is no zakah in them. However, if they are for trade, and the wealth in them reaches the nisab, then zakah is due on them when a lunar year has passed, if wealth is obtained from them and a lunar year has passed over it; he pays zakah on it. But if they are for eating, he eats them or gives them as gifts, and no wealth is accumulated from them over which a lunar year passes, then there is no zakah in them.
As for apricots and others, if they are sold and wealth is obtained from them, and a lunar year passes over that wealth, then all of this has zakah. It becomes from trade goods, just as zakah is obligatory on clothes for sale, vessels for sale, land for sale, and the like. Yes.

The presenter: May Allah bless you, Your Eminence the Shaykh. What is the criterion in this matter so that every farmer can benefit?

The Shaykh: The criterion is that zakah is in foodstuffs that are measured and stored.

The presenter: In what is measured and stored.

The Shaykh: From foodstuffs. Yes. As for what is not measured and not stored, like fruits, there is no zakah in it. Yes.

The presenter : May Allah bless you.
