What is the ruling on delaying the 'Isha' prayer until one or two hours before Fajr?

Answer:
The end of the time for 'Isha' is the middle of the night; it is not permissible to delay it until the middle of the night. The Prophet (peace and blessings be upon him) said:
the, time of the night prayer (lasts) by midnightوقت العشاء إلى نصف الليل
Sahih Muslim 612b
So it is not permissible for people to delay it after the middle of the night. If one delays it, he has committed a sin, but it is still within its time as long as Fajr has not appeared; it is a time of dire necessity. It is like delaying 'Asr until the sun turns yellow; it becomes forbidden for him, but if he prays it after the sun turns yellow, it is still within its time until the sun sets. However, it is not permissible to delay 'Asr until the sun turns yellow, nor is it permissible to delay 'Isha' until the middle of the night. Yes.
