Question:
The listener: Ahmad ibn Yahya al-Qahatani al-Nasiri sent a question saying: My mother (may Allah preserve her) often delays the 'Isha' prayer until after nine-thirty. When I discuss this with her, she says that the time for 'Isha' is long and it will not be missed (if Allah wills). What is your guidance, may Allah reward you with good?

Answer:
There is no blame on delaying the 'Isha' prayer until the end of its time for women, for those who have an excuse, such as the sick who do not attend the congregation. In fact, delaying it is better, until one-third of the night, or until what is close to half the night. This is because the Prophet (peace and blessings be upon him) said:
He prayed with his companions one night, and one-third of the night had passed, then he said: "Indeed, that is its time, were it not that I would make it difficult for my Ummah."صلى بأصحابه ذات ليلة، وقد مضى ثلث الليل، ثم قال: إنه لوقتها لولا أن أشق على أمتي
And he (peace and blessings be upon him), regarding the 'Isha' prayer, if he saw the people gathering, he would hasten it, and if he saw them slow to gather, he would delay it.
So it is better to delay it for women, for the sick who do not attend the congregation, and for those similar to them who have an excuse for not attending the congregation. As for the people of the mosques, they pray whenever they gather. If the imam delays it to wait for them until they gather, that is better due to his action (peace and blessings be upon him). And whenever they gather, he hastens it and does not make it difficult for them. Yes.
