Question:
We collected zakah funds and built a mosque with them where people learn how to pray. We know that there are no one in the place where the funds were collected who is eligible to receive this zakah. Is there any harm in doing this?

Answer:
Mosques are not to be built with zakah funds according to the more correct of the two opinions of the scholars, which is the view of the majority of the scholars. Therefore, the one who gave zakah for the construction of the mosque must return that amount and pay another zakah for the poor and the needy, or for those in debt, or for the other categories of zakah recipients. The expenditure he made for the mosque becomes a general charity, for which he will have its reward and virtue with Allah (Glorified and Exalted is He). He must also pay the zakah in its proper categories in place of the money he spent on building the mosque. This is the view of the majority of the scholars, and it is the more correct of the two opinions of the scholars, because building mosques is not among the eight categories of zakah. As for His saying, the Exalted:
for the cause of Allahوَفِي سَبِيلِ اللَّهِ
[Surah al-Tawbah: 60], the intended meaning is jihad, as is the view of the majority of the scholars. Yes.
