Answer:
The correct view is that it does not invalidate the ablution in any case, even if it is with desire, even if it is with pleasure, even if it is a kiss to your wife, for example, or touching her. The ablution is valid. This is the correct view.
Some scholars have held that the ablution is invalidated if it is with desire, but the correct view is that the ablution is not invalidated by that; rather, his ablution is valid. This is because it is established from the Prophet (peace and blessings be upon him) that he kissed some of his wives, then prayed, and did not perform ablution (peace and blessings be upon him).
As for the saying of Allah the Exalted:
or you have contacted womenأَوْ لاَمَسْتُمُ النِّسَاء
[Al-Ma'idah: 6], this refers to intercourse in the most correct of the scholars' opinions, as Ibn Abbas and a group of others said. It refers to intercourse. "You have touched" means: you have had intercourse with. Allah uses "touching" and "contact" as euphemisms for intercourse. For this reason, He said before that, "Or one of you comes from the place of relief," which is the minor state of ritual impurity. And His saying
or you have contacted womenأَوْ لاَمَسْتُمُ النِّسَاء
[An-Nisa 4:43]
is the major state of ritual impurity—intercourse. As for touching her with a kiss or with a hand, this does not invalidate the ablution in any case, whether with desire or without desire. It does not invalidate the ablution, and his ablution is valid. This is the correct view.
