The ruling on one who repents from a sin that warrants qisas (retaliation in kind) or ta'zir (discretionary punishment)

Machine translationRead the Arabic original
Question:
If a Muslim commits a sin that warrants the hadd (fixed Qur'anic punishments) and qisas (retaliation in kind), or ta'zir (discretionary punishment), and this punishment is not carried out against him, and no one knows about it, and he repents with a sincere repentance, will he be punished on the Day of Reckoning for this act, or not?

Answer:
Part of his repentance in the case of retaliation is that he makes himself available so that his victim is satisfied, or so that retaliation is carried out. As for the rest of the sins, if he repents to Allah, Allah forgives them. But if the right belongs to a created being, such as in theft, murder, or the like, then it is necessary to give the created being his right. If he does not give him his right, then repentance removes the right of Allah from him and removes the danger of entering the Fire, but the right of the murdered person and the right of the one from whom was stolen remain upon him; it must be paid on his behalf. If he repents with a valid repentance, it is hoped that Allah will pay it on his behalf. If he is unable to pay the right, then Allah (Exalted and Majestic is He) will pay it on his behalf. Those rights, if the repentance is valid, sound, and fulfills its conditions. One of its conditions is that he is unable to pay the right to the created being. Its conditions are three: regret for the past, abandoning the sin, and the sincere resolve not to return to it. These are sins related to Allah (Exalted and Majestic is He).
And there is a fourth condition related to the created being, such as blood, theft, and injustice regarding wealth and honor. This right must be paid to its owner. If he is unable to do so because his owner died and has no heirs, he gives them their right, for the right of the deceased remains. If the repentance is sincere, Allah (Exalted and Majestic is He) will suffice him from it, because he is sincere in his love for repentance and in giving him his right, but he was unable to do this because he died and there is no one after him to take the right. In that case, the matter remains between him and Allah. And Allahaccepts from His servant sincere repentance in all matters, as He, the Exalted, said:
Say, "O My servants who have transgressed against themselves [by sinning], do not despair of the mercy of Allah. Indeed, Allah forgives all sinsقُلْ يَا عِبَادِيَ الَّذِينَ أَسْرَفُوا عَلَى أَنْفُسِهِمْ لا تَقْنَطُوا مِنْ رَحْمَةِ اللَّهِ إِنَّ اللَّهَ يَغْفِرُ الذُّنُوبَ جَمِيعًا
[Surah Az-Zumar: 53].
But if the owner of the right is present, then it is necessary to give him his right or seek his forgiveness; otherwise, he will take from his good deeds according to the extent of the injustice, as he (peace and blessings be upon him) said:
Whoever has an injustice against his brother, let him seek his forgiveness today before there is no dinar or dirham. If he has a good deed, it will be taken from his good deeds according to the extent of his injustice. If he has no good deeds,من كان عنده لأخيه مظلمة؛ فليتحلله اليوم قبل ألا يكون دينارًا، ولا درهمًا، إن كان له عمل صالح أخذ من حسناته بقدر مظلمته، فإن لم يكن له حسنات

Sahih al-Bukhari 2449
.
This indicates that the right of the created being must be paid wherever possible. As for when it is not possible, Allah excuses him.And repentance is accepted, beneficial, and useful. As for the right of the created being that he was unable to fulfill, Allah is pleased with him; Allah is pleased with the owner of that right on his behalf through various types of reward and good, for He, Glorified and Exalted is He, is Generous and Bountiful. The servant is excused because he was unable to fulfill the right. Yes.

The presenter : May Allah reward you with good.
