A listener from Algeria, Aziz Abdul Rahman, sent a question saying: There is a phenomenon in our region, which is that most women make their mahr (bridal gift) in gold, in the form of jewelry, and they do not wear it except on special occasions. They claim that there is no zakah on it, relying on the opinions of some scholars, on the condition that the woman wears this jewelry three times a year?
Answer: The correct view is that there is zakah on it. There is disagreement among the scholars; some scholars hold that there is no zakah on jewelry, but the correct view is that there is zakah on it if a lunar year has passed over it. It is obligatory for the woman to pay zakah on the jewelry, whether she wears it or not, based on the saying of the Prophet (peace and blessings be upon him) to the woman he saw wearing jewelry:
Do you pay zakat on them? She said: No. He then said: Are you pleased that Allah may put two bangles of fire on your hands?أتعطين زكاة هذا؟ قالت: لا، قال: أيسرك أن يسورك الله بهما يوم القيامة سوارين من نار

, and his saying to Umm Salamah when she mentioned to him that she wears ornaments of gold, she said:
O Messenger of Allah! Is this a treasure? He said: What is not purified by zakah is not a treasure.يارسول الله! هل هذا كنز؟ قال: ما زكي فليس بكنز
This indicates that it is subject to zakah, and that it becomes a treasure if its zakah is not paid, whether it is bracelets, necklaces, rings, or otherwise, if it reaches the nisab. The nisab is twenty mithqals of gold, which is eleven and a half Saudi pounds, or ninety-two grams. For silver, it is one hundred and forty mithqals, one hundred and forty mithqals of silver, which is fifty-six Saudi silver riyals. This is the minimum nisab.
So it is obligatory for anyone who has gold or silver jewelry, whether male or female, to pay zakah if it reaches the aforementioned nisab. Likewise, the currency a person has, whether dollars, pounds, or dinars, meaning paper money, takes the place of gold and silver, and there is zakah on it. Yes.

The Shaykh: That view is weak. This view is weak, and the correct view is that there is zakah on it. The correct view is that it is obligatory for one who has jewelry that reaches the nisab to pay zakah. Not every disagreement that arises is considered valid. Allah says:
And if you disagree over anything, refer it to Allah and the Messengerفَإِنْ تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللَّهِ وَالرَّسُولِ
[Al-Nisa: 59], and He says, (Exalted and Majestic is He):
And in anything over which you disagree - its ruling is [to be referred] to Allah.وَمَاا اخْتَلَفْتُمْ فِيهِ مِنْ شَيْءٍ فَحُكْمُهُ إِلَى اللَّهِ
[Al-Shura: 10]. Yes.
The presenter: So, what do you advise one who acts according to that view?
The Shaykh: It is a mistake. We tell him: It is obligatory for him to abandon that and act according to what the text indicates. Yes.
