The ruling on a fiancé teaching his fiancée prayer

Machine translationRead the Arabic original
If the fiancée does not pray, and the fiancé teaches her prayer during the engagement period, and he makes it a condition that she prays, and it is one of the most important conditions, what is the ruling of the Shari'ah in this matter? May Allah reward you with good.
Answer: This is one of the most important matters, that he teaches her prayer and calls her to it. This is among the most blessed things, and it is obligatory. He has no right to marry her while she does not pray, if he is a Muslim. He has no right to marry her until she prays, commits herself to prayer, and repents. Likewise, she has no right to marry a man who does not pray. It is necessary that he be a praying, upright man. So the woman should strive to ensure that her husband and fiancé prays, and he likewise should strive, so that they are both praying Muslims. Many people today are lax in this matter. Perhaps the husband does not pray while she prays, or perhaps the reverse: she does not pray while he prays. So it is obligatory to be cautious, and it is obligatory that he not marry a woman who does not pray, and it is obligatory for her that she not marry a man who does not pray. Indeed, caution is required in this matter; because of the saying of the Prophet (peace and blessings be upon him):
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة فمن تركها فقد كفر
Sunan Ibn Majah 1079Sahih (Darussalam)
, so the matter is great. And he (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
, and he (peace and blessings be upon him) said:
The head of the matter is Islam, and its pillar is the Salatرأس الأمر الإسلام، وعموده الصلاة
Jami` at-Tirmidhi 2616Hasan (Darussalam)
.
So the conclusion is that prayer is the pillar of Islam, so it is necessary that the man prays and she prays. If they are affiliated with Islam, this is required. As for if they are disbelievers, the matter is different. It is permissible for a Jew to marry a Jewish woman, and a Christian a Christian woman, and a disbeliever a disbelieving woman. But as long as they are affiliated with Islam, prayer is necessary. If one of them marries the other while he does not pray, the marriage is not valid. Indeed, it is necessary that they both be praying, or both not praying. They must be united in prayer or in its absence. As for if one of them prays and the other does not pray, then the marriage is not valid according to the stronger of the two opinions of the scholars; because abandoning prayer is major shirk, even if he has not denied its obligation. Yes.
