The ruling on one who leaves off the sa'y in Hajj, relying on the sa'y performed in 'Umrah

Machine translationRead the Arabic original
Question:
He says in a second question: I performed the obligatory Hajj three years ago. I performed the arrival tawaf and the sa'y between al-Safa and al-Marwah. I also performed the farewell tawaf, but I did not perform the sa'y between al-Safa and al-Marwah because I did not know that it was required. When I went to al-Madinah al-Munawwarah to visit the Noble Prophet’s Mosque, I learned from the brothers that I am required to perform the sa'y between al-Safa and al-Marwah after the farewell tawaf. Some of them advised me to pay a fidyah, while others said that nothing is required of me if I was ignorant of it. Is my Hajj valid, or do I have to pay a fidyah, or what should I do? May Allah reward you with good.

The Shaykh : Repeat it. Yes.

Answer:
Your question is vague and lacks detail, but we will clarify it for you so that you know the reality. If you entered the state of ihram for 'Umrah, performed the tawaf and the sa'y, and then shortened your hair or shaved it to exit the state of ihram from the 'Umrah as a mutamatti', and then you entered the state of ihram for Hajj and performed Hajj with the people, and you performed the tawaf of ifadah, and you performed the farewell tawaf but did not perform the sa'y, then this is a mistake on your part. You must perform the sa'y, even now. You must go to Makkah and perform the sa'y with the intention of the previous Hajj, and there is no blame on you for performing the sa'y with the intention of the previous Hajj. You must also pay a fidyah if you had sexual intercourse with your wife after that: a sacrificial animal to be slaughtered in Makkah for the poor. This is because you approached your wife before performing the sa'y, which is an act of Hajj, and the first sa'y was for the 'Umrah. As for the second sa'y, it is required of you for the Hajj, along with the tawaf of ifadah that you perform after your arrival from Mina on the Day of Sacrifice or after it. As for the farewell tawaf, it is independent when leaving Makkah. This farewell tawaf is an independent obligation to bid farewell to the House when leaving Makkah. And you must refrain from sexual intercourse until you perform the sa'y.
However, if you entered the state of ihram for Hajj, or for both Hajj and 'Umrah, and you remained in your state of ihram, performed the tawaf and the sa'y, and remained in your state of ihram without exiting it until you went to Mina while still in ihram, then nothing is required of you. The tawaf of ifadah is sufficient for you, other than the farewell tawaf. The tawaf of ifadah, and then the farewell tawaf when leaving. If you performed the tawaf of ifadah when leaving, it suffices for the farewell tawaf. If you performed one tawaf of seven circuits when leaving, it suffices for the farewell tawaf. And you do not have to perform the sa'y. The first sa'y is sufficient if you entered the state of ihram for Hajj alone, or for both Hajj and 'Umrah, and did not exit the state of ihram, but remained in your state of ihram until you went to Mina and until you performed the Hajj. Then nothing is required of you except the first sa'y. And success is from Allah.

The presenter : May Allah reward you with good.
