The third question in the letter from the brothers: Ali Muhammad Far' al-Yamani, Ali Hasan 'Abd, and 'Abd al-Rahman Muhammad Ali Saleh from the Yemen Arab Republic, they say in it:
Is it permissible for the people of Makkah and those performing tamattu' to perform tawaf and sa'y before going up to 'Arafah without going out to al-Hil, or is it necessary to go to al-Hil and enter the state of ihram from there so that they can perform the tawaf of arrival and the sa'y of Hajj before the Hajj? And what is the ruling for one who does that without going out to al-Hil? Please inform us, may Allah reward you.
Answer: For the people of Makkah and others who have exited the state of ihram from 'Umrah in Makkah, it is the recommended practice (sunnah) for them, when they enter the state of ihram, to head to Mina, whether their ihram is from al-Hil or from al-Haram.
It is the recommended practice (sunnah) for them to head to Mina, just as the Prophet (peace and blessings be upon him) and his Companions (may Allah be pleased with them) headed to Mina on the eighth day. The Prophet (peace and blessings be upon him) ordered the Companions to head to Mina on the eighth day and to enter the state of ihram for Hajj, and he did not say to them: "Enter Makkah and perform tawaf and sa'y" or "perform tawaf only," but rather he ordered them to head to Mina while reciting the talbiyah. This indicates that the one who has exited the state of ihram from 'Umrah in Makkah, and likewise the people of Makkah if they intend to perform Hajj, and likewise the residents there, if the eighth day comes and they intend to perform Hajj, they enter the state of ihram from their homes or from any place and head to Mina. It is not prescribed for them to enter Makkah for tawaf and sa'y. Rather, this is for the one who arrives from afar, the one who comes from a distance. It is prescribed for him to begin with tawaf and sa'y, then exit the state of ihram from 'Umrah if there is ample time. If the time is tight, he goes to Mina in his state of ihram, whether he is in the state of ihram for Hajj or for Qiran. As for the one who is in the state of ihram for 'Umrah only, and he is the one performing tamattu', then after tawaf and sa'y, he shortens his hair or shaves it. The recommended practice (sunnah) is to shorten the hair if the 'Umrah is close to the Hajj, so that shaving is available for the Hajj.
And after he shortens his hair from his 'Umrah, he recites the talbiyah for Hajj and then heads to Mina, and he does not perform tawaf and sa'y after reciting the talbiyah for Hajj. Rather, he recites the talbiyah for Hajj and immediately heads toward Mina without tawaf or sa'y. This tawaf and sa'y that the one in the state of ihram from Makkah performs in Hajj does not suffice him if he performs tawaf and sa'y after entering the state of ihram for Hajj in Makkah; it does not suffice him because it is not prescribed. Rather, the tawaf and sa'y take place after that, after his descent from 'Arafah on the Day of 'Eid or after it. This is the prescribed tawaf for the one who entered the state of ihram from Makkah, whether he is from its people, a resident there, or one who has exited the state of ihram. And success is from Allah.
