Question:
His Eminence, the distinguished scholar, Shaykh: Abdul Aziz ibn Abdullah ibn Baz, may Allah preserve you and protect you.
Peace be upon you, and Allah’s mercy and blessings, and after that:
We are young men from the al-Darraj district in Yemen:
We submit to you this letter containing two important questions, hoping for a written answer to them so that we may present them to our people. May Allah guide you to what is right and correct in all your words and deeds:
Q: We have a large mosque that accommodates all the worshippers, and it is the only one in the area. Our problem is that there is a (grave) next to the mosque. The mosque was expanded due to the people's need, and the grave ended up inside the mosque. We have built a barrier for the grave to separate it from the mosque and prevent worshippers from praying behind it, knowing that the grave is in the rear of the mosque? We can move the grave to the cemetery without any problems, especially if you issue a ruling to that effect? What is the ruling on praying in this mosque given the situation we have described?
Answer:
The answer: And upon you be peace, and the mercy of Allah and His blessings. As for what follows:
It is obligatory for you to remove the grave from the mosque, and it is not permissible to bury in mosques, nor to build mosques over graves; because the Prophet (peace and blessings be upon him) said:Sahih Muslim 529 It is agreed upon as authentic. So we ask Allah to guide everyone to what pleases Him, and peace be upon you and the mercy of Allah and His blessings.
