Whoever says this is a disbeliever. Whoever says that not praying is better, or not fasting is better, or not paying zakah is better, or not performing Hajj is better, is a disbeliever. Likewise, if he says: "There is no harm in ruling by other than the Shari'ah; it is permissible," or if he says: "The ruling of the Shari'ah is better, but if he says: 'Ruling by other than what Allah has revealed is permissible' or that it is good,' all of this is apostasy from Islam, may Allah protect us from it.

Likewise, whoever loves and is pleased with what Allah has forbidden and says that it is good and suitable, such as unlawful sexual intercourse and theft, is also a disbeliever. Yes.
