One who combined 'Umrah with Hajj and was content with only the sa'y of 'Umrah
Machine translationRead the Arabic original
We begin with a message from 'Atiq ibn Salman al-'Atiq from Riyadh. He says: We performed Hajj, and with us was a student of knowledge, and we trusted him. We combined 'Umrah with our Hajj from al-Sayl, so we performed tawaf and sa'y. After the tawaf of ifadah, we did not perform sa'y. Is our Hajj valid or not? May Allah reward you with the best reward for the Muslims?
Answer: In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and blessings and peace be upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance.
As for the one who combines 'Umrah with Hajj, he is the one who enters the state of ihram for 'Umrah from the miqat, completes it, and then performs Hajj in that same year; he is called a mutamatti' in the terminology of the scholars. Likewise, the one who enters the state of ihram for both 'Umrah and Hajj together and remains in his state of ihram until he performs Hajj is also called a mutamatti', and he is called a qarin by the people of knowledge. These two are required to offer a sacrificial animal (hady). This is the one who entered the state of ihram for 'Umrah from the miqat, exited from it, and then entered the state of ihram for Hajj; he is called a mutamatti'. And that one who entered the state of ihram for both together from the miqat, whether the miqat of Madinah, the miqat of the people of Najd, or otherwise, and continued in his state of ihram until he completed his Hajj; both of them are required to offer a sacrificial animal. As for the sa'y, the one who exited from his state of ihram must perform a second sa'y, while the one who did not exit but remained in his state of ihram has the ruling of the one who performed Hajj alone (mufrid), who is only required to perform one sa'y. The conclusion is that the one who combined 'Umrah with Hajj and exited from his 'Umrah must perform a second sa'y for his Hajj, and the first sa'y is for his 'Umrah. This is what is prescribed. The one who issued a fatwa to you that you do not need to perform sa'y issued a fatwa based on an opinion stated by some scholars, and we ask Allah for his pardon and forgiveness. However, the majority of the people of knowledge hold the opinion that is stronger of the two, which is that the mutamatti' who completed his 'Umrah in the months of Hajj and then entered the state of ihram for Hajj in his year is required to perform a second sa'y for his Hajj, and the first sa'y is for his 'Umrah. This is what is prescribed, and this is the stronger of the two opinions, and it is the opinion of the majority of the people of knowledge. So if you, O questioner, hear this, you must perform sa'y for your previous Hajj at this time. There is no harm in doing so at this time or later. You must perform sa'y for your previous Hajj. And you must slaughter a sacrificial animal as a precaution for your intercourse with your family, if you have a wife and you had intercourse with her after Hajj. You must slaughter a sacrificial animal in Makkah for your intercourse with her before you perform sa'y, as charity for your approaching your wife. It should be in Makkah for the poor of the Haram. This is what is prescribed by way of precaution and to avoid the disagreement of the scholars, and it is what the Sunnah indicates. Indeed, when the Prophet (peace and blessings be upon him) performed Hajj, his companions were in three groups: some entered the state of ihram for 'Umrah and exited from it, some entered the state of ihram for both Hajj and 'Umrah together as a qarin, and some entered the state of ihram for Hajj alone. So the Prophet (peace and blessings be upon him) ordered those who entered the state of ihram for Hajj alone, or for both Hajj and 'Umrah together, to make it an 'Umrah and to exit from their state of ihram. They responded, listened, and obeyed, and they exited from their state of ihram, except for those who had a sacrificial animal with them, for they remained in their state of ihram. And he ordered those who had exited from their 'Umrah to perform a second sa'y for their Hajj after they returned from Mina, as al-Bukhari narrated from Ibn 'Abbas (may Allah be pleased with them both), and as it came in the two Sahihs from the hadith of 'A'ishah (may Allah be pleased with her) that she said: "As for those who exited from their 'Umrah, they performed another tawaf for their Hajj—meaning between al-Safa and al-Marwah." This is what is relied upon. Yes.
