He also has another question: He says: If a person is obligated to perform a duty in a certain area and his provisions run low and he needs food, and he finds gardens or abandoned houses containing fruits, vegetables, or food, is he permitted to eat from them to satisfy his hunger, or not? And in conclusion, peace be upon you and Allah's mercy.
Answer: There is no doubt that if he is in need, he eats what he needs without carrying anything away. If he needs to eat from the garden, from the fruits in it, or from an empty house that has food in it, and he is in need, hungry, and has no provisions, he eats what he needs and there is no blame on him. As it came in the hadith:
If a needy person takes some with his mouth and does not take a supply away in his garment, there is nothing on himمن أصاب بفيه من ذي حاجة فلا شيء عليه
Sunan Abi Dawud 4390Hasan (Al-Albani)
when he passes by a garden. The point is that if he eats from these fruits or other things that are eaten, there is no blame on him, but he does not carry anything away; he only eats what he needs.
