This message regarding lost property was sent by the listener Salih Ahmad Asker. He says: I hope that this message of mine will be presented to His Eminence Shaykh Abdul Aziz. The question is: If a person finds an item thrown on the road, is he permitted to take it or not?
Answer: If he trusts that he will be able to identify it and fulfill the obligation, he should take it; otherwise, let him leave it. This is because it is obligatory for him to identify it for a full year. He should call out for it in the markets where people gather, at the doors of the congregational mosques, and similar places where people assemble, saying: "Who is the owner of this thawb? Who is the owner of this thawb? Who is the owner of this vest? Who is the owner of this bag? Who is the owner of such-and-such? Who is the owner of such-and-such?" He should not describe its characteristics, but rather indicate its nature without describing its characteristics. If someone comes who knows it by its characteristics, he gives it to him. If a year passes and no one comes, it is his. This is how the Prophet (peace and blessings be upon him) commanded the one who finds lost property to identify it, after he has identified its container, its tie, and its count, if it is currency.
The point is that after he identifies it, whether it is currency or not, after he identifies the reality and the descriptions that should be preserved, if he masters them, he writes them down with him, controls them, and identifies it for a full year. He calls out in the gatherings of people two or three times a month, or more: "Who is the owner of this thawb? Who is the owner of the lost item which is such-and-such?" For example, a bag, for example, a vest, for example, a sword, for example, a dagger, for example, such-and-such. Then, if the one seeking it comes, he describes its characteristics: what are its characteristics, and what is such-and-such? If he describes it with matching characteristics, he gives him that lost item. If the year passes and no one comes, it is like the rest of his wealth; he benefits from it like the rest of his wealth. If its owner comes one day in the future and describes its characteristics, he gives it to him. Yes.
